Do I Need a Permit for a Marquee?
In most cases, you do not need planning permission to install a marquee
on private land. However, there are some important exceptions depending on how the marquee is used.
Private land and gardens
If your marquee is being installed on private land such as a garden or private field,
you will usually not need permission if:
It is temporary and removed within 28 days
It is for private use (such as a party or family event)
It does not block access or create safety issues
This applies to most bookings across areas such as
Birmingham,
Tamworth,
Solihull and
Sutton Coldfield.
Public land and open spaces
If you plan to install a marquee on public land such as a park or open space,
you will need permission from the local council.
This usually involves:
Approval from the landowner or council
Event planning documentation
Proof of insurance
Safety and risk assessments
Temporary Event Notices (TENs)
Even if you do not need planning permission, you may still require a licence if your event includes:
Selling alcohol
Live or amplified music
Public attendance or ticketed entry
In these cases, you may need a Temporary Event Notice (TEN), which should be applied for at least
10 to 20 working days before the event.
Time limits
Marquees are classed as temporary structures. To avoid planning permission:
The marquee should not remain in place for more than 28 days
Safety requirements
Regardless of permissions, safety must always be considered.
Proper anchoring depending on ground type
Safe access and exit routes
Fire safety considerations
Suitable spacing and layout
For setup guidance, see the Hard Surface vs Grass Setup Guide.
When should you check with the council?
You should contact your local council if:
The event is large or public
The marquee is on public land
You are unsure about licensing requirements
The event includes alcohol or entertainment
Summary
Most private marquee hires do not require permission.
Additional licences may be needed for public events, alcohol or entertainment.
If you are unsure, it is always best to check before booking.
